6c 26-02599:35 a.m. Public Hearing - Consideration of proposed Major Use Permit PL-25-67 (UP 21-40) 140 Soda Bay Road, Design Review PL-25-67 (DR 23-06), and Mitigated Negative Declaration PL-25-67 (IS-21-42), for no more than 43,200 square feet (sf) mixed-light commercial cannabis cultivation, a 6,000 sf processing and non-volatile manufacturing facility, and a 2,400 sf distribution facility located at 140 and 270 Soda Bay Road, Lakeport (APNs 008-001-08 and 008-001-09)

    I would like to express concern that more in-depth and current biological studies should be completed before a final determination of less-than-significant impact is made. This project is located in a very important wetland and tributary area connected to Manning Creek, where Clear Lake hitch are currently spawning. Manning Creek can overflow during wet periods, and those overflow areas may extend into adjacent parcels, including the Lake County Land Trust’s Kuulanapo Preserve, an important conservation property within the Clear Lake watershed. Because of the proximity to conserved land, riparian habitat, and seasonal floodplain areas, biological surveys should be current and conducted in multiple seasons. The existing assessment does not appear to include multi-season studies, nesting bird surveys, or focused bat surveys, even though this area supports riparian wildlife, migratory birds, and several bat species. Without updated surveys, mitigation measures may not fully address the biological importance of this site. I respectfully request that updated multi-season biological studies be completed before concluding impacts are less than significant.
