6b 25-8669:20 A.M. PUBLIC HEARING - Consideration of proposed Major Use Permit (UP 24-01/ PL-25-25), MIT Farms, and Initial Study/ Mitigated Negative Declaration (IS 24-01/ PL-25-25) for approval of a commercial outdoor cannabis cultivation of up to 42,066 sf canopy; located at 22368 and 22430 Jerusalem Grade, Middletown (APNs:136-071-02 and 03). Applicant: MIT Farms LLC
Please deny without prejudice or condition approval on the following pre-work requirements:
1. File an executed CDFW LSAA before any bed/bank or culvert work on Class II/III channels.
2. Submit stamped hydrology/hydraulics proving both crossings pass the 100-year flow with sediment/wood (36" pipe; 12′×5′ box).
3. Provide current State Water Board enrollment under WQ 2023-0102-DWQ, CGP/SWPPP coverage for grading, and any required 404/401 or WDR determinations.
4. Include the full AB 52 consultation record and require a tribal monitor during ground disturbance.
5. Verify water supply with a 24-hour late-summer pump test and adaptive curtailment triggers.
6. Obtain CAL FIRE fire-safe access and water-supply concurrence.
